(March 2024) Request for Town of Belville, NC Government: List of all current employees and salaries. As of the present day.

Good afternoon Sharon, Athina, Brenda, (or Custodian(s) of these Records),

Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

The type of basic salary data I’m requesting is simple to provide, is very commonly produced, and is widely considered a matter of public record as part of the public personnel file of employees. Many NC entities fulfill requests like this via email in 1 week, and in many cases 1 day.

Please provide the names and salaries of all current Town of Belville, NC employees, as of the present day [on the date the query is performed]. Please include the following:

1) Employee first / last name
2) Date of hire
3) Position / title / department
4) Salary [including hourly wage, hourly rate, or salary -- whichever payment structure is applicable to the employee]

Ideally, I’d like to receive the responsive records in an Excel or other machine-readable format. If any / all of this info is already publicly available online, please provide a link to where it can be accessed.

    I appreciate your help, and I’m sure you will not “get into trouble” for fulfilling a basic salary data request which I submitted directly to the appropriate entities / custodian(s) of those records under NC Public Records Law. It was also not even possible for me to fill out the request form on your site. 

     

    I would like to suggest that someone in the IT department (or whomever is responsible for adding those forms to the Town’s website) please take a look at how the current form is set up, and modify it in such a way to make it easily accessible and possible for users to edit the form. I consider myself to be a very tech savvy person, and I couldn’t figure out how to paste in or even add screenshots or type text to the Request form in any way that was legible.

    Good evening Richard,

     

    To reiterate. Sharon already sent me the form you’ve referenced, after I submitted my request to the appropriate custodian(s) of those records directly on 03/12/24. Additionally, all of the info this form asks me to fill out has already been provided to the Town of Belville via my original request and email. I included a name, email, address, details about the request, etc.

     

    That said … I am using a Mac computer and downloaded the form. I just spent nearly 30 minutes attempting to fill it out, but it’s virtually impossible to edit or insert information on this document, so I have given up. The info literally does not fit into your form, and therefore I cannot provide it to you. Perhaps if you try editing the form yourself you will see what I mean.

     

    In any case, it is not required under the law that I must resubmit my request to you again, using the form on your website, in order for you to fulfill it. This serves as an unnecessary burden to access public records and is not in the spirit of the public records law, particularly because I’ve already sent the request to the appropriate departments / custodian(s) of the records.

     

    I have previously provided all of the info your form asks to collect (please see attached). This is a very simple request for salary data, and having been provided all of the necessary info, hopefully you will now proceed to process the request without further delay as required by Law.

    As I explained to Sharon already — I did not see that request form, or any info about “submitting public records” or “records request policies” anywhere on the Town’s website when I submitted my request on 03/12:

    By Law I do not have to submit an address, name, phone #, purpose, (or resubmit a request using a form you’d like me to fill out) — in order for you to process my request. However, that being said … there isn’t enough space on the form you and Sharon provided for me to write my request.

     

    Since Sharon, Brenda, and Athina are all listed as either Administration or Finance contacts for the Town of Belville, I submitted my request to them directly as the custodian(s) of these records — which the custodian is obligated to fulfill by law.

     

    Please proceed to fulfill my request. I will follow up again in 1 week, if I haven’t heard anything else before then.
