(May 2020) Request related to City of Brevard, NC government social media policies

Good Afternoon City of Brevard, NC Government,

I'd like to make a public records request (under NC Public records law NCGS 132) for the following information:

This request is related to City Council members and their engagement / use of their personal social media profiles to communicate with citizens concerning matters undertaken by the City of Brevard.

I would like to know what policies have been implemented by the City government to ensure that these communications have been archived in order to comply with NC G.S. 132 and the North Carolina Department of Cultural Resources' Municipal Records Retention Schedules.

Please provide the most responsive information as of the date the query is run.

    Here is the response from the City’s Human Resources Director Kelley Craig.

     

    Jill,

     

    I have spoken with Jason Woolf with the NC Department of Cultural Resources to get a better understanding of the City’s responsibility with personal accounts.

     

    Because these are personal accounts the City does not have any responsibility for retention. Any public records requests for posts/information on personal social media accounts of elected officials would need to be submitted to the elected official.

    Good afternoon City of Brevard, NC,

     

    We hope you’ve been well and are staying safe during this unusual time in which we find ourselves. We’re noting here so that the sender is aware, that Michael stated back in April that the City of Brevard Government is experiencing delays in their processing of records requests due to the outbreak of COVID-19.

     

    We’ve received a new public records request via our website www.sunshinerequest.com for info that may be available in your office. Please confirm receipt to let us know that the request will begin processing, and if possible, please provide a rough estimate of when the request may be completed. We will plan on following up again around that time.

     

    We’ve learned through our previous correspondences with Michael and Jill related to other requests that, “the City does not respond to anonymous FOIA requests. When you submit a FOIA request on behalf of a third party, we require the requesting individual party’s name, address and proof that he or she has executed the request and designated your organization to make the request on his or her behalf. If there is a cost for the copies, we will let you know that before responding to the request, and your organization or the requesting party must agree to pay that cost.”

     

    Please note that we are not making a FOIA request. We are making a public records request under NC Public records law NCGS 132, under which there is no provision requiring an individual to provide a name or address with a public records request. That being said, if it will help speed along the request we are happy to provide a name and address –– you can consider that this request is made by Patrick Conant, who is the director of Sunshine Request.     We’d also like to ask that the requested information be delivered in a digital or machine readable format if possible. Please note that we cannot commit to covering any fees / associated costs related to any requests on our site.
