Hello Stanly County, NC Schools (Records Officer),

I'd like to make a multi-part public records request for the following information under NC Public Records Law.

This request is related to Vendor I-Leadr@RtI:Stored! documents at Stanly County Schools from 01/01/2017 - 10/01/2022.

Please provide all proposal(s), written agreement(s), scope(s) of work, and purchase order(s) related to vendor I-Leadr@RtI:Stored! for student data. Additionally please provide the documents showing the funding source(s) used for paying vendor I-Leadr@RtI:Stored! . The responsive records should include all results during the specific time period of January 01, 2017 through October 01, 2022.

I am not requesting to come in person to inspect, nor to obtain printed copies of, electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

I do not have any additional or further clarifying info to provide other than what you see in the message above. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law.

    I have attached the files requested that originally did not exist in a digital format, only in paper format which would have needed to be copied or converted as they were originals stored by our finance department as stated in the January 13 email. The original documents you received in November were sent in error and did not pertain to your request. In the future, all public records requests will need to be completed using this online form.     I’ve been following up with you and Michelle since November to see when the redacted documents you mentioned would be sent over. You can see now why I was surprised to receive a message from Hope on 01/13 suddenly requesting payment for “printed copies” of documents, and with no other explanation for the charge within the invoice itself.

     

    I appreciate that you understand my concern about this billing issue, and I thank you for waiving the fee!

     

    To-date Sunshine Request (www.sunshinerequest.com) has never received any payments related to the running of our website, or for our team’s time to fulfil requests made through our site. We are entirely self-run, and we operate the site as an addition to our company’s primary work duties. Therefore, currently we do not have funds available to spend towards fees for making records requests. We do know certain entities may be permitted to charge reasonable fees, as prescribed by Public Records Law. For this reason, we have learned over time to always indicate in our initial request that by submitting it we are not committing to pay potential fees / associated costs related to the request — and if it’s not possible to process it without incurring fees, then to let us know the itemized potential cost and explanation for the charge upfront, and we’ll decide how to proceed.

     

    If I do not receive the redacted files this month, I’ll reach back out to you directly to follow up.

    The documents will be sent to you, I thought they already had been. However, I think I need to clarify the issues.

     

    Most of the original documents sent to you were not the documents you requested. They were sent to you by accident. The actual documents you requested were only in hard copy and had to be scanned in, which does generate a cost much like printing. This was the reason for the charge, which is permissible. The charge was not for redaction time or administrative time. However, we are appreciative you did not post the first set of docs inadvertently sent and since we did not inform you of a cost upfront, which you requested, the charge will be waived.

    I’m just following up on your previous message. Please let me know when I can expect to receive the redacted records responsive to my request.

     

    Michelle already fulfilled the original request, electronically … And the records were provided to us on 11/21/22. However, you also asked us at that time that we do not post the results until your office could go back and redact / resend the corrected information. We have been waiting to receive the updated records you mentioned from either you or Michelle since 11/21/22, so I’m especially unclear about any fees Hope is trying to collect now, long after-the-fact.

     

    As you may know, under NC Public Records Law you cannot charge fees for the staff time required to redact or separate confidential from non-confidential information in public records — That cost burden is yours to bear.

    I’m following up again on all my messages above since January 13. I have not received any response.

     

    I want to express again my concern regarding management of this public records request. I worry that SCS is not processing public records requests in compliance with the Law.

    I have no intention of paying an arbitrary fee for obtaining records I requested back in November 2022, and it does not seem at all justified to request fees now as described in the invoice above from Hope. Not only did I not ask for the records to be compiled in any special manner / format / medium in which they do not already exist, but also there was no discussion regarding fees from SCS whatsoever (either before or during the records process).

     

    The original request was already fulfilled by you and Michelle, and the records provided to us, electronically … However, you also asked us at that time that we do not post the results until your office could go back and redact / resend the corrected information. We have been waiting to receive the updated records you mentioned from either you or Michelle since 11/21/22, so I’m especially unclear about what fees Hope is trying to collect now. As you may know, under NC Public Records Law you cannot charge fees for the staff time required to redact or separate confidential from non-confidential information in public records — That cost burden is yours to bear.

     

    Additionally — the SCS records policies about fees Hope has cited and invoiced me for, is non-compliant with NC Public Records Law (in the current manner the charges have been described within the invoice). The invoice says that I’m being charged $0.25 per page, for black and white copies which, were not requested — and yet, I know from yours and Michelle’s emails to me that the records are electronically available, since you’ve already sent them to me once — And, per Hope’s own explanation to me, it turns out that the charge is actually intended to be for SCS’s time spent to scan, not print, paper copies of records. In which case, the invoice I’ve been sent does not even reflect that cost, nor does it itemize or explain whether the charge is for staff spending “an excess of 4 hours” to copy those documents into an electronic format… if that is what Hope is suggesting.

     

    I respectfully ask that you and legal staff take immediate action to resolve this issue, and to ensure that ALL public records requests are being fulfilled by SCS as required under NC Public Records Law.

    I’m still wondering, however, why scanning documents into an electronic format would result in a fee of $0.25 per page for “hard copies”? Your policies above indicate that there is a fee “per black and white page”. If you didn’t have to physically print off these records, and I’m not picking up printed files, it’s unclear how there would be any associated cost necessary — unless, you’re actually trying to collect fees for staff time in excess of 4 hours. (But that wouldn’t make sense either).

    I’ve reviewed the link you referenced:

     

    D. Fees for Copies of Public Records

     

    Persons requesting copies of public records will be charged any applicable fees as determined by the records officer (see subsections B.1.d and B.1.e, above).  The school system shall not charge any fees for separating confidential information that is commingled with public records.

     

    The standard fee for hardcopies of records will be $0.25 per black and white page.  In addition, any request for public records requiring more than four (4) hours to reproduce shall constitute an extensive use of personnel and will be subject to a special service charge of $25 per hour for each hour in excess of four (4) hours.

     

    I did not request to obtain “printed copies” or “hard copies” of electronic records, and, in accordance with Public Records Law I have not requested that any records be compiled or provided to me in any format in which they do not already exist.

     

    Can you please clarify why fees would be charged for records that you’ve just said are available electronically, and please explain how the calculation was made for “$50.50”? The only information in your invoice says: “202 pages @ .25 cents each Public Records Requst”.  This statement suggests that there were 202 pages of responsive records, and that none of them existed in an electronic format, and, that you had to manually copy (and for some reason print them out, rather than scan) 202 pages of hard copies?

     

    I’d like this information stated explicitly, so that I can indicate it to any future requesters on our website, as well as to help our team understand how SCS is making this determination in accordance with NC Records Laws.

     

    Once I receive that clarification, I will review how we’d like to proceed from here.

    We process hundreds of public records requests through our website, so I want to ask if you can you please confirm your message above is related specifically to the fulfillment of the public records request called:

     

     

    The request called for:

     

    “… all proposal(s), written agreement(s), scope(s) of work, and purchase order(s) related to vendor I-Leadr@RtI:Stored! for student data. Additionally please provide the documents showing the funding source(s) used for paying vendor I-Leadr@RtI:Stored! . The responsive records should include all results during the specific time period of January 01, 2017 through October 01, 2022.”

     

    For one thing, this request has not yet been completed, as you can see from our email thread with Dean and Michell. It has been in the process of fulfillment for several months.

     

    Second — I am unsure why you’ve attached an invoice to our team for copies for this request, or why SCS would expect payment for pulling such a simple records request. Please provide an explanation as well as what calculations were used to determine this fee. Our team never approved such a fee, nor were we ever notified of any such possibility, or provided with any itemized potential costs. Therefore we have no intention of paying that charge.

     

    As was explicitly stated in the original request:

     

    “I am not requesting to come in person to inspect, nor to obtain printed copies of, electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

     

    I do not have any additional or further clarifying info to provide other than what you see in the message above. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law.

    NC Records Law clearly states that “… If it is necessary to separate confidential from nonconfidential information in order to permit the inspection, examination, or copying of the public records, the public agency shall bear the cost of such separation.”
