Ideally, I’d like to receive the responsive records in an Excel, or other machine-readable format. If any / all of this info is already publicly available online, please provide a link to where it can be accessed.

Thank you for your message, and thanks for following up with HR.
I requested basic salary data (name / position / date of hire / salary) for “Public Works Commission” employees working as of the present day. Basic salary data requests are very commonly produced, and widely considered a matter of public record for all NC employees. Most entities produce this type of record in 1 week, or in most cases, one day.
You’ve referenced a particular section of NC Records Law that says “… nothing in this section shall be construed to require a public agency to respond to a request for a copy of a public record by creating or compiling a record that does not exist.”
It’s unclear if you’re saying now that FPWC was initially unable, or unwilling, to produce the “date of hire” data field as requested. I just want to clarify — if you do have access to the data, it is simple to produce an electronic report. You are not being asked to create or compile a record that doesn’t exist by simply having to “generate a report” in order to produce that electronic data. That is not the same thing as “creating a record that doesn’t exist.”
I’ll check back in next week if I don’t hear anything else before then.

I am happy to assist with your request, but please note that the North Carolina public records statute at issue does not require that new records be created in response to your request. In other words, the materials previously sent to Sunshine comprise all records in existence that are responsive pursuant to N.C.G.S. § 132- the law does not require that our organization undertake to create new records tailored to provide specific content per each public records request. That said, I will follow up with our human resources department to see if it’s feasible to compile add a new field containing hiring dates in the records you’ve already received. I’ll confirm later today. Thank you.

This is my third and final attempt to follow up with you regarding the following public records request. I submitted it to your offices on October 22:

I have not received a response to my emails on Nov. 06 and Nov. 21.
To reiterate:
The document you sent back on 11/06 did not include the “date of hire” (as I requested). I’m asking again that you please update the document, and resend it to me to include the “Date of hire” field.
Under NC Public Records Law, your office is required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my emails, then this could be considered a denial of a request. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”. http://www.ncpress.
