In accordance with North Carolina State Statute § 132-1-6, I respectfully submit the following request for public documents as they are made or received by the county government and its staff of Transylvania County, carrying on public business.

I would like access to any and all emails and any other documentary materials that relate to or were generated in conducting the business of the County Commission appointed Cedar Mountain Small Area Plan, also knowns as CMSAP, SAP, the Small Area Plan, or Small Area Planning Process for Cedar Mountain. Specifically, the e-mails I am requesting may be addressed to, written by, or copied on the following county employees and officials: Jamie Laughter, Allen McNeal, Jason Chappell, Jake Dalton, Mike Hawkins, Page Lemel, Larry Chapman, Theresa McCall and David Guice.

Specifically, I am requesting any and all emailed and mailed correspondence between county officials as wells as emails to county employees and officials in regards to a call for comment on the Cedar Mountain Small Area plan and all the names is it otherwise known by.

The frame for this request, includes all public documentation, from Nov. 1, 2020 to June 7, 2021.

I believe that that a reasonable time for a response is 30 days.

I appreciate your prompt response acknowledging the receipt of this request during normal business hours.”

    I’m following up again on my last email [dated: Apr 11, 2022, 1:20 PM. subject: Re: Records Request: (July 2021) Request for Transylvania County, NC: Cedar Mountain Small Area Plan communications 11/01/2020 – 06/07/2021]

     

    Since March 21st I have continued to ask for specific clarification related to this request, and have yet to receive a clear response specifically answering my questions about “documents” on March 28, April 04, and most recently on April 11.

     

    For now I am going to mark this July 2021 request as “Denied” on our website. If you or Andrew wish to respond to my April 11, 2022 email at some point in the future, I’ll be happy to reopen this request at that time.

    Thank you for your reply!

     

    We understand you’re saying some of the responsive records did not already exist digitally, and so for simplicity you ended up printing all of the request results in their entirety. However, since many of those records do already exist in an electronic medium, that is still what we’re requesting.

     

    I’m sorry if you’ve spent time printing the entire request, but you can omit from the request the “documents” that you’ve said didn’t exist digitally and had to be printed… We will not be picking them up in person, but we’ll note on our website that any requesters can follow up with you directly if they want to inspect those documents.

     

    However, related to the portion of the request asking specifically for “all communications [emails] [electronic documents] [text messages] [and any other electronic medium]” – It’s unclear why any of the responsive files would have to be printed and inspected in person. Those records already exist in an electronic medium, and we’re not asking you to create a format (in this case printed copies) that didn’t exist at the time the request was made. You should be able to provide those to us electronically under NC Public Records Law.

     

    We’re still asking that you please provide clarification regarding the“documents” portion of the request you and Trisha have cited – Specifically, where we’ve been saying:

     

    “Those are already in a digital format (electronic medium) and you should be able to provide those to us under NC public records law. Since these are records that already exist in an electronic medium, it is unclear if / why the files would need to be printed, if that is the case…I would appreciate it if you could send a digital copy of the requested digital records – Under NC Public Records Law you should be able to provide these in an electronic format such as Google Drive, Dropbox, emailed response, .PDF, CD / flash drive (if necessary), etc.”

     

    If size is your concern, then ideally a public Dropbox link or Google Drive folder is the best solution here…but if that isn’t possible, and mailing a CD or Flash drive is what is required, please let me know and we’ll be happy to provide a mailing address (PO Box) at that time.

     

    If you’re still unable to complete the request for some reason, please let me know, and we’ll ask that future requesters follow up with your office directly.

    Documents, responsive to your request currently exist in paper format and are available for production in that same format. The documents were printed so that unresponsive information could be removed.

    We understand that you might be referring to the fact that the “mail” or “other written documents” specifically requested may not already be available in an electronic medium, and do not have to be provided that way – While it would have been helpful to hear that feedback earlier on during this process, if it isn’t possible to send those records electronically, then that’s fine. We will omit that portion of the request, and will note this on our website. The original sender can make that request in person if they’d like to inspect those records, as we cannot commit to cover any fees related to the requests on our site.

    “I understand if there is a maximum file size that can be shared via email. However, isn’t it possible that you can just create multiple .zip files or send in multiple number emails, so that the files are not too big to send?

     

    I’d like to request again, that if the records are ultimately too large to send via emailed file share, that you please find a way or create a public Google Drive folder(s) / link(s) or some other file formats to transfer the files electronically.

     

    I do not need physical copies of associated files for this request, nor is it required by law that I must come to your office in person to pick up records, if you are suggesting that’s the only way they can be provided. We are based in Asheville, NC.

     

    I would greatly appreciate it if you could send a digital copy of the requested records – Under NC Public Records Law you should be able to provide these in a digital format such as Google Drive, Dropbox, email, pdf, CD / flash drive (if necessary), etc.
