[See Editor’s Note](March 2020) “Follow up” submission related to Grandfathered STRs that DID NOT meet Homestay requirements

Hi City of Asheville, NC Government,

This is a follow up request related to a Completed request [(February 2020) Request for City of Asheville, NC Grandfathered Short Term Rentals info] found here: https://www.sunshinerequest.com/records_request/february-2020-request-for-city-of-asheville-nc-grandfathered-short-term-rentals-info/.

I’d like to ask that the request be “reopened” and updated, to now include the following (3 requests below). The previous request asked for:

- “Please provide a list of any and all grandfathered Short Term Rentals, or STRs that have been allowed and approved which did not or do not meet the Homestay requirements (such as not having owner/applicant residing on property, etc).

- Additionally, I would like to request the criteria under which those grandfather exceptions occurred and whether that was made available to all parties who received violation notices regarding STRs.

- The above requests should include all responsive information from June 01, 2015 - January 26, 2020.”

I feel that the questions have not been fully answered. Specifically,

- “Please provide a list of any and all grandfathered Short Term Rentals, or STRs that have been allowed and approved which did not or do not meet the Homestay requirements (such as not having owner/applicant residing on property, etc).

This question is referring to Grandfathered Short Term rentals that DID NOT MEET the homestay requirements, yet were permanently considered OK and grandfathered, while others were not allowed that same status, or even given the opportunity to be.

1. Please provide the “who” or “why” of such statuses being granted.

I also feel that the responsive documents, and response from Terry, did not answer the question, but seemed to refer to more recent grandfathering of properties that DID meet the Homestay requirements.

- From Terry - “STVRs were grandfathered if they were operating with a permit in 2018. The records that I provided to you on February 14, 2020, are the only records responsive to your request.”

The request was for ones that DID NOT (such as not having the owner on site and living in part of the dwelling....no stoves, etc).

2. I’d like to request that you please provide a list of any and all grandfathered Short Term Rentals, or STRs that have been allowed and approved which did not or do not meet the Homestay requirements (such as not having owner/applicant residing on property, etc).

3. Additionally, I would like to request the criteria under which those grandfather exceptions occurred and whether that was made available to all parties who received violation notices regarding STRs.

I’d like to update the above requests to now include all responsive information from June 01, 2015 - March 27, 2020.
