Hello Transylvania County, NC Tourism Development Authority (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law:

Please provide all written and electronic documents [emails, memorandums, and meeting minutes] concerning the TDA separating from the Brevard / Transylvania Chamber of Commerce.

Specifically -- I'm requesting all correspondences sent to and sent from any members of the TDA, the Chamber, as well as the public, and all public documents, which discuss the TDA's decision to separate from the Brevard / Transylvania Chamber of Commerce.

All of the responsive records requested should include the specific time period of 02/01/2021 through 08/29/2021.

Additionally -- Please provide all .pdfs, files, attachments, videos, hyperlinks, etc. that are indicated within the responsive records. For example: A .pdf that is an attachment within an email, should also be provided as a document along with the responsive emails.

Please include all of those additional documents where applicable, as relates to the requested information above.

If the records are ultimately too large to send via emailed file share, I'd ask that you please create a public Google Drive folder / link or some other file format to transfer the files electronically.

    This is in response to the below request made via your website. Out of respect for the request and open records laws, we compiled a great deal of information to the best of our ability in order to accommodate this request. Below is a recap of the attachments and key information regarding the process of gathering the information. Feel free to let me know if you have any questions.
    • One attachment includes the packet of information for each board meeting during the requested dates
    • The remaining attachments are all emails sent to or from members of the board or staff on the requested topic. They were compiled based on the following:
    • A search by the executive director (ED) of all emails to/from the ED to/from any of the TCTDA board, the chamber board, county staff, and other key individuals who were communicated with on this topic. This resulted in a significant majority of the attached emails.
    • It was not practical to search all emails to/from the ED to/from Chamber staff since that includes dozens of emails to each employee daily and thousands of emails to review over that period. Plus, there were very few emails to/from these parties outside of the board packets. Instead, the ED searched any emails to/from the executive director to/from all Chamber staff (including those who primarily work on TCTDA tasks and those who do not) that include the keywords “contract”, “organization”, or “structure”. The Chamber staff were also instructed to produce any emails either to/from the ED or anyone on the topic.
    • A search by the ED of all emails filed in the email folder “TCT / Chamber Contract Review” in the executive director’s gmail account as a double check on all of the above.
    • A request to TCTDA board members to search their own emails and submit any emails sent to any party that did not include the executive director as a “to”, “cc”, or “bcc” recipient.
    • All of these emails were compiled by printing the last email in the chain and including all prior emails in that chain and any attachments included at any point in the chain. When in doubt, prior emails were included so there may be some duplication.
    • These emails are chronological, based on the last email in the chain. • There was no other practical way to compile this information. It seemed more beneficial to the request and more efficient to do it this way rather than break down an email exchange into multiple parts (each email in the chain) spaced dozens or hundreds of pages away if each part is included separately and chronologically. There are multiple attachments with titles corresponding to the dates included.

    This email is to acknowledge receipt of the below request.. The TCTDA will work on the fulfillment of this request based on the parameters laid out in the email. We are a small organization with limited staff, so it will likely take weeks to compile this information. The Brevard/Transylvania Chamber is not a public organization so it is not subject to public records requests and will not be providing information. It is worth noting that certain staff members, like myself, are heavily involved in TCTDA work but actually work for the Chamber. In those cases, all of our communication does fall under public records requirements, so that information will be included, whether it is to/regarding members of the TCTDA board or the Chamber board.
