I’d like to ask again that you please provide an anticipated date of completion for this records request, sent to the City on September 25, 2020.
The request was removed from the City’s email queue spreadsheet at some point after Sep 25, 2020 (when Terry White told us “… This request is number 19 in the email queue”) and Jan 28, 2021 (when Liz Harper told us, “This request is now number 5 in the queue”). Therefore, we cannot track its progress without emailing you directly.
On March 09, 2021 Liz Harper said: “… This search has been completed and the resulting 2,300 emails have been divided among four members of our legal team for review. Once they have been reviewed, I will send along all that are responsive.”
The last we heard was from Allison on October 11, 2022: “… I apologize for my delayed response. There is no further update on this request (#21-69) at this time; it is still in the final stages of legal review. As soon as legal review is complete, I will forward you the link to all responsive records.”
It is unreasonable that a 2+ year old request for emails covering a 3 month period (07/01/20 – 09/30/20) sent and received by 1 person, and reviewed by 4 members of a legal team for nearly 20 months, has not been fulfilled by now.
Please provide a timeline for completion. I will check in with you one more time early next month if I do not hear back before then.

I’m following up again to ask for an anticipated date of completion for this request that was first sent to the City on September 25, 2020.
The request is now over 2 years old. On March 09, 2021 then Public Records Officer Liz Harper indicated:
“This search has been completed and the resulting 2,300 emails have been divided among four members of our legal team for review. Once they have been reviewed, I will send along all that are responsive.”
The most recent update I received was on July 26, 2022:
“This request is still in the final stages of legal review. As soon as legal review is complete, I will forward you the responsive records.”
As it is almost 2 years old and has been “under legal review” for nearly 1.50 years … I ask that you please provide an estimated date for completion as well as an explanation for the delay, and, why the “legal review” of this request has taken so long. Is this typical?
I’ve also noticed that the request is no longer in the City’s “Email queue” spreadsheet:
– Terry White. Sep 25, 2020. “This request is number 19 in the email queue.”
– Liz Harper. Oct 29, 2020. “Your request is currently number 18 in the queue.”
– Liz Harper. Dec 11, 2020. “This request is now 16 in the queue. I hope to make significant progress on the email queue in the next month. Thank you for your patience.”
– Liz Harper. Jan 28, 2021. “This request is now number 5 in the queue.
– Sunshine Request. Mar 23, 2022. “We are aware that the City has a spreadsheet for the Public Records Email Search Queue, however this request does not appear to be listed there? The last update we received on this request was back on 12/7/21 when Leslie said: “…This is a large request and we are actively working on finishing up the review. I expect to have it completed within a few weeks. “
– Open Gov. Jul 26, 2022. “This request is in the final stages of legal review, and I hope to have it wrapped up soon. As soon as legal review is complete, I will forward you the responsive records.”

We have followed up 4 times since Leslie’s 12/07/21 email with no reply. I am aware that the City has a spreadsheet for the Public Records Email Search Queue we can look at for updates. However, for some reason our September 2020 request does not appear to have been listed in that queue as of this writing…
It also appears that the request was entered into the City’s Next Request portal by the City back in August 2021: https://cityofashevillenc.nextrequest.com/requests/21-69. As there have been several changes in staffing / records processes in the past years, for simplicity we’ve been following up on our original request thread via email to this point.
