The bases for denial of this request are as follows:
1. The North Carolina Public Records Law does not apply in this case. Matters of the Eastern Band of Cherokee Indians (a sovereign nation recognized by federal treaty) are governed by act of the Tribal Council, which propounds the Cherokee Code of Ordinances and other regulations. The Tribal Code can be found here: https://library.municode.com/tribes_and_tribal_nations/eastern_band_of_cherokee_indians/codes/code_of_ordinances.
2. Chapter 132 of the Code deals with Tribal public records. This law requires, in section 132-5(b) that “The [public records] request must also state the date, name, address and telephone number of the requesting member, and must be signed by the requesting member.” In other words, this essentially limits requests to enrolled members of the Tribe.
3. Please note that even if your request were properly identified with an enrolled member of the Tribe, there may be other grounds upon which it would be subject to denial. I do not explore those grounds here.
