(August 2023) Multi-part request for Transylvania County, NC Board of Education: Info about possible closed meeting related to 07/24/23 Board appointment. And, specific emails and texts sent from Board Members, 04/01/23 – 07/24/23.

Good Afternoon Transylvania County Board of Education (or Records Officer / Custodian of Records), all others CCed,

Please reply promptly to the following public records request, which is being made in accordance with NC Public Records Law.
Ref: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

** I’m simply requesting an electronic copy of an electronic record, if one exists. I am NOT asking to come in person to inspect, nor to obtain a printed copy of, these electronic records. I’m requesting explicitly that any responsive info be provided to me via an electronic medium / format (in which the copy of these records should already exist).

I do not have any further clarifying info I wish to provide to narrow this request. If the request is unclear, or if you are unable to fulfill any or all parts of the request, then please specifically cite where a reason for its denial is justified under NC Public Records Law. **

This a multi-part request, related to a recent Transylvania County Board of Education member appointment:

A. I believe that at some point from 06/06/23 through 07/24/23 a closed meeting was held with at least three of the Transylvania County Board of Education members – where it was decided to appoint the new Board member (who was later appointed at their regular monthly meeting on 07/24/23). If such a record exists: Please provide the date, location, and meeting minutes of that closed meeting held prior to the regular 07/24/23 meeting.

B1. Please provide all Emails and Texted messages Sent From any and all Board of Education Members – specifically, those communications where Mr. Bryan O'Neill's name is mentioned. During the time period of 04/01/23 to 07/24/23.

B2. Please provide all Emails and Texted messages Sent From any and all Board of Education Members – specifically, those communications where the appointment of a new board member to replace Mr. Ron Kiviniemi was discussed. During the time period of 04/01/23 to 07/24/23.
——————

** Please note that by submitting this request, I’m NOT agreeing to pay any potential fees or associated costs related to my request. If it isn’t possible to process the request without incurring fees, then please let me know the itemized potential cost and explanations for those charges upfront, and DO NOT proceed until I respond.

By Law I’m not required to provide a name or address to associate with a public records request, but in order to move things along I’d like to clarify that this request is being made by:

Sunshine Request
PO Box 17391
Asheville, NC 28816

The request has been sent solely from the email address [email protected] . If anyone other than that email address contacts you to pursue a similar request, it did not come from me or my Team. Please do not commingle or treat that as an alteration or cancellation of my request – I intend to continue to pursue my request.

Thank you for your assistance!

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

08/02/23 Editor’s Note: The original submission(s) above have been merged into 1 request, and have also been revised for clarity.

Sunshine Request will not fulfill the following types of requests:

☀️ Requests that are incomplete, non-specific, or vague.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific information the requester hopes to receive. In this case, the sender may rewrite and resubmit the request.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

☀️ Requests that are only informational questions, and requests that are not addressed to government entities.

Sunshine Request is a site built to make requests for public records to the government — Public records are recorded information such as documents, government emails, and data sets.

In the interest of preserving our team’s time to focus on the high volume of requests on our site, as well to respect the staff time of government entities fulfilling records requests, Sunshine Request will no longer fulfill “requests” that are just informational type questions for government entities to answer.

We also will not fulfill requests made to non-government entities.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

☀️ Requests that include profanity, personal statements, opinions, possibly defamatory statements, or other unnecessary info that is not relevant to making a records request.

Please do not include personal opinions and statements in the request’s Subject or Message. Please omit any extraneous statements that are not specific to the exact information you’d like to receive. This is not relevant information pertinent to the processing of a records request, and the request will not be published.

☀️ Please be specific:

It is important that what you are requesting is specific and reasonable, and is an actionable records request. Please specify the exact type of records you’d like to receive, rather than any “possible” or “potential” info that could be searched. Remember that the larger your request, the more time it usually takes to fulfill. Specificity will often help reduce the amount of time needed to process the request.

It is important that a request has a clearly written and complete Subject and Message, and also specifies the Government Entity (or entities), City and/or County, and State to which the request should be sent. If applicable, please also include any responsive timelines for the info that should be requested.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific info the requester hopes to receive, or if it violates our policies.

Before submitting a request, please take a moment to review our tips for How to write and make a successful request. If you have additional questions about our site or how to make requests, please check out our FAQs or Policies page.

☀️ Code of Conduct: Please do not use Sunshine Request or any of the results of public records requests to harass government entities / employees, businesses, private citizens / individuals, or otherwise.

☀️ Please note that we cannot pay any fees / associated costs related to any of the requests on our site. If it is not possible for a Government Agency to process our request without incurring fees, then it is the responsibility of that Agency to let us know what the potential costs may be — at which point we will ask that they cease processing the request. We will mark the request as “Completed” on our site, and the sender can contact the Government Agency directly, should they wish to further pursue a request.

Thank you for using Sunshine Request!

    12/06/23. Editor’s Note to Sender:
Patrick Conant is the Director of Sunshine Request. He called Brian today at 1:45pm and left a voicemail. Patrick indicated that we submitted two public records requests to Transylvania County Schools, and that he understands Brian has exchanged several emails with members of our Team about those requests. And that, at this point we thought it would be easiest if Patrick just calls Brian to discuss how to get the requests fulfilled. Patrick left his number, and asked Brian to call him back.

If we do not hear back from Brian or TCS this week, then Patrick will follow up with Brian’s office in the coming 1 – 2 weeks (as soon as his availability allows). Any updates we receive from Brian or TCS about either request, will be posted on our website:

Good afternoon Brian, Board of Education, Jen, Trisha, and all others CCed,

I submitted the following public records request to the Board via email on August 03:

This is a valid public records request, and it has been made in accordance with NC Public Records Law as well as Transylvania County Schools “Policy Code: 5070/7350 Public Records – Retention, Release, and Disposition.”

On October 11th, Brian Weaver said: “Per the Board’s directive, any requester can confirm the request and they will come to the District’s central office to collect any responsive documents.”

TC Schools and TC Gov have fulfilled my public records requests many times before. I’ve stated to Brian repeatedly that I am a real person making a valid public records request under NC Public Records Law NCGS 132, under which there is no provision requiring an individual to provide a name, address, explanations, or even a purpose to associate with a public records request.

That being said, if it helps speed along the request without further delay, I’m happy to provide a name and address, again –– You can consider that this request has been made by Patrick Conant, the director of Sunshine Request. Address is PO Box 17391, Asheville NC, 28816. Email: [email protected]

I am formally “confirming” this request, once again, and having provided you with this information you should now proceed to fulfill the request.
    ———-

Patrick would be happy to collect any responsive documents in person, if they ONLY existed in a physical format. However, in the case of this specific request, we have requested solely electronic documents. Therefore, under NC Public Records Law you can, and are required to, provide them electronically. You can provide them via email, Google Drive, Dropbox, flash drive (if it’s absolutely necessary), another electronic format, etc.

Please proceed to fulfill the request without further delay. ** If you are unable / unwilling to fulfill any or all parts of the request, then please specifically cite where the reason for its denial is justified under NC Public Records Law. **

Please let me know when you anticipate these public records will be provided to me. I will follow up again in 1 week, if I do not hear back.

    Thank you.

Hi Brian, and all others CCed,

Following up on my message to you from Wed, Oct 11, 10:47 AM. I have not heard back.

    To reiterate —

I have requested an electronic copy of these records in their native format, delivered to me via email, dropbox link, google drive, if necessary a thumb drive, etc.

While I would be happy to retrieve records if they ONLY existed in a physical format, this records request specifically asked for electronic records. Thus, under NC Public Records Law you are required to provide them to me electronically.

Brian Weaver has fulfilled several other records requests I’ve submitted in the past. He confirmed on August 07 that, “The public records request has been received and will be processed in a reasonable amount of time”.

I received the following email from Brian on September 27: “Dear Sunshine Request, Per the N.C. Public Records Law, individuals can request to inspect and copy public records. Therefore, the Board of Education is happy to comply with such requests. Please ask the individual to make such a request to obtain available public records, if any.”

I’ve considered Brian’s message, and upon further review I think that perhaps his message was meant to suggest that I’m not a “person” or “individual”, and that the Board is happy to comply only with requests made by “individuals” ?

I have made a public records request to you under NC Public Records Law NCGS 132 – under which there is no provision requiring an individual to provide a name, address, phone #, or even a purpose, in order for you to process a public records request. By Law requestors are not required to provide this information. However, in order to move things along I’d like to clarify, again, that this request is being made by:

    Sunshine Request

    Asheville, NC 28816
    Email: [email protected]

This is not an anonymous request, as you may be suggesting, and my contact info was provided to you when the request was submitted. I am a real person making a records request to your office in accordance with NC Public Records Law.

Please proceed to fulfill the request. ** If you are unable / unwilling to fulfill any or all parts of my request, please specifically cite where the reason for its denial is justified under NC Public Records Law.**

    Thank you!

    Hi Brian,

Can you please confirm whether or not there are even any responsive records that exist for Part A. of the request? I’m also certain that if such a record (a date, a location, or minutes) does exist, that you can produce it via an email, and that any minutes that were taken are also available to you in their original electronic medium.

Regarding Parts B1. and B2. NC Public Records Law clearly provides the authority for me to request public records in any and all media in which the public agency is capable of providing them. And, that my request in any particular medium shall not be denied because you prefer to make the records available in some other way.

By Law, I am allowed to request these records in any medium in which they are available to you. Therefore, I’m asking for you to please email me those records, or send me a link to where they can be accessed. If the texts and emails I’ve requested are available as google links, in a google drive folder, some file or document you need to send me, etc. that is also sufficient. I’ve made a public records request for public info that is available to you in an electronic format currently, and therefore it can and must be provided to me in this manner.

If you are denying my request as it was written, please state this explicitly. Please specifically cite where its Denial is justified under NC Public Records Law.

I’ll consider my next steps from there.

    Thank you.

    Good afternoon Brian,

To clarify. I am the “individual” (person) you’re referring to, making the request. I first submitted it to Transylvania County on Aug. 03, 2023:

Multi-part request, related to a recent Transylvania County Board of Education member appointment:

Bryan O’Neill’s name is mentioned.

You confirmed on Aug. 07 that, “The public records request has been received and will be processed in a reasonable amount of time.”

Nearly two months after submitting the request, I’m surprised to hear now that you don’t intend to fulfill the request as written. You also have not specified whether there are any records responsive to my request: “Per the N.C. Public Records Law, individuals can request to inspect and copy public records. Therefore, the Board of Education is happy to comply with such requests. Please ask the individual to make such a request to obtain available public records, if any.”

Thank you for confirming I can ask to inspect and copy public records. As I stated in my request — I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, this electronic record. Nor would it make sense to do so in this case. I’ve requested explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this electronic record already exists). NC Public Records Law does not provide an exemption to your requirement under the law to produce public records in the format that they are available to you, simply because you’d prefer to produce them in another format.

Part A. Please clarify whether these records exist. I’m certain that if there is such a record (date, location, minutes) you’re able to produce it via email, and that any minutes taken are also available to you in their electronic medium, online.

Parts B1. B2. Suggesting I must come in person to inspect emails / text messages, is clearly intended to create an unnecessary burden and barrier to access public records.

I’d like to reiterate that I expect to receive the responsive records in their native format. This is the easiest method and simple for you to query/compile/produce. I’m not asking for that info to be compiled or reviewed in a special way. NC Public Records Law clearly provides the authority for me to request public records in this manner (in any and all media in which the public agency is capable of providing them). And, that my request in any particular medium shall not be denied because you prefer to make the records available in some other way.

Please specify whether you plan to fulfill my request as written. If not, please cite specifically where the reason for its denial is justified by Law. I’ll consider my next steps from there.

    Thank you.

    Dear Sunshine Request,

Per the N.C. Public Records Law, individuals can request to inspect and copy public records. Therefore, the Board of Education is happy to comply with such requests. Please ask the individual to make such a request to obtain available public records, if any.

    Good afternoon,

The public records request has been received and will be processed in a reasonable amount of time.

    Kind regards,

Good Afternoon Transylvania County Board of Education (or Records Officer / Custodian of Records),

I’d like to make a public records request for information that may be available in your office. If you’re not the appropriate party to contact about the request, please provide the correct name and email address of whom I should send it to.

Please confirm receipt to let me know the request will begin processing, and if possible, please provide a rough estimate of when the request may be completed. I will plan on following up again in 1 week, if I have not heard back before then.

Here are the details of the request:

    SUBJECT:

(August 2023) Multi-part request for Transylvania County, NC Board of Education: Info about possible closed meeting related to 07/24/23 Board appointment. And, specific emails and texts sent from Board Members, 04/01/23 – 07/24/23.
