Please reply promptly to the following public records request, which is being made in accordance with NC Public Records Law.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I am NOT asking to come in person to inspect, nor to obtain a printed copy of, these electronic records. I’m requesting explicitly that any responsive info be provided to me via an electronic medium / format (in which the copy of these records should already exist).

I do not have any further clarifying info I wish to provide to narrow this request. If the request is unclear, or if you are unable to fulfill any or all parts of the request, then please specifically cite where a reason for its denial is justified under NC Public Records Law. **

This a multi-part request, related to a recent Transylvania County Board of Education member appointment:

A. I believe that at some point from 06/06/23 through 07/24/23 a closed meeting was held with at least three of the Transylvania County Board of Education members – where it was decided to appoint the new Board member (who was later appointed at their regular monthly meeting on 07/24/23). If such a record exists: Please provide the date, location, and meeting minutes of that closed meeting held prior to the regular 07/24/23 meeting.

B1. Please provide all Emails and Texted messages Sent From any and all Board of Education Members – specifically, those communications where Mr. Bryan O'Neill's name is mentioned. During the time period of 04/01/23 to 07/24/23.

B2. Please provide all Emails and Texted messages Sent From any and all Board of Education Members – specifically, those communications where the appointment of a new board member to replace Mr. Ron Kiviniemi was discussed. During the time period of 04/01/23 to 07/24/23.

    12/06/23. Editor’s Note to Sender:
    Patrick Conant is the Director of Sunshine Request. He called Brian today at 1:45pm and left a voicemail. Patrick indicated that we submitted two public records requests to Transylvania County Schools, and that he understands Brian has exchanged several emails with members of our Team about those requests. And that, at this point we thought it would be easiest if Patrick just calls Brian to discuss how to get the requests fulfilled. Patrick left his number, and asked Brian to call him back.

     

    If we do not hear back from Brian or TCS this week, then Patrick will follow up with Brian’s office in the coming 1 – 2 weeks (as soon as his availability allows). Any updates we receive from Brian or TCS about either request, will be posted on our website:

    This is a valid public records request, and it has been made in accordance with NC Public Records Law as well as Transylvania County Schools “Policy Code: 5070/7350 Public Records – Retention, Release, and Disposition.”

     

    On October 11th, Brian Weaver said: “Per the Board’s directive, any requester can confirm the request and they will come to the District’s central office to collect any responsive documents.”

     

    TC Schools and TC Gov have fulfilled my public records requests many times before. I’ve stated to Brian repeatedly that I am a real person making a valid public records request under NC Public Records Law NCGS 132, under which there is no provision requiring an individual to provide a name, address, explanations, or even a purpose to associate with a public records request.

Therefore, the Board of Education is happy to comply with such requests. Please ask the individual to make such a request to obtain available public records, if any.”

     

    I’ve considered Brian’s message, and upon further review I think that perhaps his message was meant to suggest that I’m not a “person” or “individual”, and that the Board is happy to comply only with requests made by “individuals” ?

     

    I have made a public records request to you under NC Public Records Law NCGS 132 – under which there is no provision requiring an individual to provide a name, address, phone #, or even a purpose, in order for you to process a public records request.     Can you please confirm whether or not there are even any responsive records that exist for Part A. of the request? I’m also certain that if such a record (a date, a location, or minutes) does exist, that you can produce it via an email, and that any minutes that were taken are also available to you in their original electronic medium.

     

    Regarding Parts B1. and B2. NC Public Records Law clearly provides the authority for me to request public records in any and all media in which the public agency is capable of providing them. And, that my request in any particular medium shall not be denied because you prefer to make the records available in some other way.

     

    By Law, I am allowed to request these records in any medium in which they are available to you. Therefore, I’m asking for you to please email me those records, or send me a link to where they can be accessed. If the texts and emails I’ve requested are available as google links, in a google drive folder, some file or document you need to send me, etc. that is also sufficient. I’ve made a public records request for public info that is available to you in an electronic format currently, and therefore it can and must be provided to me in this manner.

     

    If you are denying my request as it was written, please state this explicitly. Please specifically cite where its Denial is justified under NC Public Records Law.

    Nearly two months after submitting the request, I’m surprised to hear now that you don’t intend to fulfill the request as written. You also have not specified whether there are any records responsive to my request: “Per the N.C. Public Records Law, individuals can request to inspect and copy public records. Therefore, the Board of Education is happy to comply with such requests. Please ask the individual to make such a request to obtain available public records, if any.”

     

    Thank you for confirming I can ask to inspect and copy public records. As I stated in my request — I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, this electronic record. Nor would it make sense to do so in this case. I’ve requested explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this electronic record already exists). NC Public Records Law does not provide an exemption to your requirement under the law to produce public records in the format that they are available to you, simply because you’d prefer to produce them in another format.

     

    Part A. Please clarify whether these records exist. I’m certain that if there is such a record (date, location, minutes) you’re able to produce it via email, and that any minutes taken are also available to you in their electronic medium, online.

    Parts B1. B2. Suggesting I must come in person to inspect emails / text messages, is clearly intended to create an unnecessary burden and barrier to access public records.

     

    I’d like to reiterate that I expect to receive the responsive records in their native format. This is the easiest method and simple for you to query/compile/produce. If such a record exists: Please provide the date, location, and meeting minutes of that closed meeting held prior to the regular 07/24/23 meeting.

     

    B1. Please provide all Emails and Texted messages Sent From any and all Board of Education Members – specifically, those communications where Mr. Bryan O’Neill’s name is mentioned. During the time period of 04/01/23 to 07/24/23.
