(October 2022) Request for City of Raleigh, NC Government: Emails about “Carolina Pines”. 01/01/2020 through present day.

Hello City of Raleigh, NC Government (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law.
Ref: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

Please provide ALL emails Sent or Received by the following people, that include the text "Carolina Pines". From January 01, 2020 through the present day (date the query is performed):

[email protected]
[email protected]
[email protected]
[email protected]
[email protected]
[email protected]

I am not requesting to come in person to inspect, nor to obtain printed copies of, electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

I do not have any additional or further clarifying info to provide other than what you see in the message above. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law.
--------

[** Editor’s Note: This request has been sent solely from the email address [email protected] . If anyone other than that email address contacts you to pursue a similar request, it did not come from our Team. Please do not commingle or treat that as an alteration or cancellation of our request – We intend to continue to pursue our request.

Please note that we cannot commit to sign any forms or pay any potential fees / associated costs related to any request. If it is not possible to process the request without incurring fees, then please let us know the itemized potential cost.]

Thank you for your assistance!

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

    Hi Sarah,

Thank you for providing that explanation and letter. It’s very likely that my Team and I will need to send you future public records requests, so I do just want to reiterate the following:

Although the submissions sent to our Team / website may be anonymous, the person (me) who is actually submitting a formal public records request to your office to fulfill, is not.

By Law I am not required to provide a name or address to associate with a valid public records request, but I’d like to clarify again that this request was made by:

    Sunshine Request
    PO Box 17391
    Asheville, NC 28816

The request was sent solely from the email address [email protected] . If anyone other than that email address ever contacts you to pursue a new or similar request, then it did not come from me or my Team at www.sunshinerequest.com .

If you ever receive communications / emails from anyone other than that address — then it should not be commingled or treated as an alteration or cancellation of my requests in any way.

That said — I will note the information you’ve provided today on our website, and will now mark this request as “Completed”.

Any future requesters are encouraged to reach out to your office directly, should they wish to further pursue a narrowed request. Or, they can submit a new and narrowed request to our website, following the recommendations you’ve provided to this point.

    Thanks for your help!

    Hi Sarah,

I hope you are well. Happy Friday!

I’m following up on my last message to you on March 08 regarding potential fees. To reiterate:

This records request was first sent via your records form on 10/24/2022. I did confirm on 10/25/2022 that the email query info you provided back to me was correct. The request asked for:

“… ALL emails Sent or Received by the following people, that include the text “Carolina Pines”. From January 01, 2020 through the present day (date the query is performed):

    [email protected]
    [email protected]
    [email protected]
    [email protected]
    [email protected]
    [email protected]

I understand you’re saying it will take some time to review / redact / fulfill the request as is, and it would be helpful to you if I’m willing to narrow it down. I appreciate the consideration and organization to “batch” the queries as well. However, I do not have additional or further clarifying information to provide about the request, other than what you see above.

Sunshine Request (www.sunshinerequest.com) is an anonymous, free community project built by our small 3-person team in Asheville, NC. We created the platform to make it easier for citizens to make public records requests. We allow users to anonymously submit requests to our Team to fulfill, and we don’t require any personal info to be submitted in order for our Team to process requests. This means we also cannot verify who submits a request to our website, or how / if any responsive records may be used (by anyone other than our team). We also do not know how frequently they may want to make the same or similar requests. (In North Carolina that type of detail is not legally required in order to process requests). We do not send the results of requests directly to individuals, and we publish the results of all completed requests on our website, for the benefit of the public.

Once we submit a request it cannot be narrowed or “cancelled”, unless we determine that it’s absolutely necessary for some reason, or if there is some justification under NC Records Law why it cannot be fulfilled by your office.

It would be helpful if you can please provide an explanation of the actual amount of search results you found, as well as an approximate timeline / number of staff hours it might take to process the request as is, and then I will consider my response from there. I’d like to understand how “large” of a request this is, and whether it’s necessary to be narrowed at all, before I attempt to provide any additional information for future senders (if they were to narrow and submit a new request). I imagine that if the sender wanted to omit certain types of files, they would have specified that.

    Thank you for your help!

subject: RE: Catalog Task TASK0151389 has been assigned to group Public Records

    Good Morning.

The public records request you submitted yielded an exceptionally high number of records, thousands of which will require redactions. Producing all of these will take a significant amount of time. The email search criteria was:

Inboxes or Workgroups: [email protected] [email protected]

    [email protected] [email protected]

    [email protected] [email protected]

    Date Range: January 01, 2020 through October 24, 2022

    Key Words: “Carolina Pines”

To be responsive to your request without generating unnecessary staff work, we are asking that you consider narrowing the date range from which to pull records, as well as other specific criteria to include in a search query. For example, if you do not need emails about individual payments to parties (the routing forms between staff members, digital copies of checks, and/or emails about people making appointments to sign paperwork); or you do not need records to/from parks and recreation.

If you would like to specify more than one search, we can run them in priority order, and provide results to you in batched. An example is below.

    Search 1

    Dates: January 01, 2020 through December 31, 2020

    Keywords: “Carolina Pines”

Inboxes or Workgroups: [email protected] [email protected]

    [email protected] [email protected]

    [email protected] [email protected]

Excluding: Emails to/from Parks and Recreation, Emails about individual payments or that include copies of checks

    Search 2

    Dates: January 01, 2021 through December 31, 2021

    Keywords: “Carolina Pines”

Inboxes or Workgroups: [email protected] [email protected]

    [email protected] [email protected]

    [email protected] [email protected]

Excluding: Emails to/from Parks and Recreation, Emails about individual payments or that include copies of checks

    Search 3

    Dates: January 01, 2022 through October 24, 2022

    Keywords: “Carolina Pines”

Inboxes or Workgroups: [email protected] [email protected]

    [email protected] [email protected]

    [email protected] [email protected]

Excluding: Emails to/from Parks and Recreation, Emails about individual payments or that include copies of checks

Again, the more specific you can be to the other criteria, such as external urls (ex. @sunshinerequest.com), internal departments, and dates. The more effective we can be in running a search for you and providing records.

    Thank you.

    Sarah

    Hi Sarah,

I hope you’ve been well, and are having a good week so far.

Thanks again for your reply on 01/31/23 regarding the following records request:

This is a best practice to be responsive to your request without generating unnecessary staff work, we ask requestors to provide specific criteria, including a specific date range (if you do not provide on, our default search term is one year), as well as the individual name(s) or department(s) or workgroup(s).

Based on your submittal the search criteria is:

Inboxes or Workgroups: [email protected] [email protected] [email protected] [email protected] [email protected] [email protected]

Date Range: January 01, 2020 through the October 24, 2022

    Key Words: “Carolina Pines”

The more specific you can be, the more responsive we can be in initiating an e-mail search and providing records. If these criteria are correct, your search will be added to the cue when you confirm.

    Thank you.

    Sarah
