Hello Guilford County, NC Schools (Records Officer),

I'd like to make a multi-part public records request for the following information under NC Public Records Law.

This request is related to Travel records for Guilford County Schools employees from 01/01/2018 - 12/01/2020.

Specifically – I’d like to request all information from Guilford County Schools pertaining to out-of-county work travel and any consulting travel from January 01, 2018 through December 01, 2020 for former Guilford County Schools employees Sharon Contreras and Tony Watlington.

The responsive records should include the following:

- Place of Travel:
- Purpose of Travel:
- Length of Travel:
- Itemized Cost of Travel for Housing, Food and Transportation:
- Documentation of Travel Approval by School Board and Finance Department:
- Documentation of any Honorariums, Speaker Fees Payments and Consulting Payments:

I am not requesting to come in person to inspect, nor to obtain printed copies of, electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

I do not have any additional or further clarifying info to provide other than what you see in the message above. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law.

“Having made numerous attempts to follow up, and receiving no reply — We [marked] this request as “Denied” by GCS. If at some point Jose or GCS decide to reply, then we will reopen the request at that time.

Additionally– If the sender would like to submit a new records request through our website, then we will be happy to submit it to GCS’ records portal. It’s possible that may help get a response.”

We will submit the new January 2023 request to GCS, and all updates we receive will be indicated on our site. We anticipate, however, that it will be difficult to get a response to our emails… and if so, we will need to call GCS follow up. We’ll do that as soon as is possible.

We plan to follow up with GCS about that again this week or next. We will have to call someone to figure out why our emails / requests continue to bounce back and/or why our email address seems to have been “blocked” by GCS’ FOIA account.


Additional Note for Users: Sunshine Request does not control if / when Government entities will confirm receipt, begin processing, complete, or deny requests we submit to them via our website.     – Or, is the $400 cost based on an “hourly rate” for Staff to copy and print records, scan and digitize them? etc.

     

    Anyone who wants to pursue a request that might have fees attached, should always be made aware upfront of how that potential cost is being determined.

     

    I’d also like to ask you again to please provide me with a copy (or weblink) of Guilford County School’s policies for charging / assessing “fees” related to public records requests. If you do not have any policies about records requests, then please specify this.

    I appreciate the offer to inspect the other 1000 supporting documents. However, this will not be possible for our small team. We run Sunshine Request in addition to our primary business. It’s not feasible that we spend time traveling to Greensboro to inspect, pick up, copy, and scan documents.

     

    You mentioned there will also be a “cost” should anyone want to retrieve those documents. Please note that we cannot commit to pay any fees related to this request. I assume you mean there would be a cost to “copy” and “print” all 1000 documents, should someone request that. Or, maybe you mean that it will take time for you to scan and digitize these documents and there will be a cost? (That would be ideal so that the files become electronic records).

     

    To repeat from my last message:

    Am I to believe it is impossible for you to provide ANY of the responsive records to me in any way other than hardcopies of documents to inspect in-person? Are you saying GCS does not keep ANY digital records at all related to the time / place / cost / approval of out of county consulting and travel expenses? And, that those records cannot be emailed?

     

    2) Please explain any calculations you’ve used to determine a cost for this request — or, how much staff time did you estimate is required to produce this information (at what $ rate are you using to make that calculation?).     3) Your responsiveness to this [and other] records requests I’ve submitted to you has been unacceptable. I want to express again my concern that GCS has not been processing records requests “promptly” and in accordance with NC Public Records Law: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

     

    My Request Number: PRR-4-2023 was first submitted to your records portal on January 11, 2023 at 3:45pm EST. The message I received was:

     

    … “Please have this reference number available when communicating with our staff regarding your request. If you have supplied an email address, you will receive a confirmation of your submission that contains the above information. Please note that if you chose not to provide contact information, this reference number should be used when communicating with staff and/or when picking up the records related to this request. Additionally, if no contact information was provided, you must contact the appropriate office to verify receipt of your request, to learn of any applicable fees, and authorize your request to move forward, prior to your request moving forward.”

     

    I provided all of the necessary details, and had to follow up with you [and others at GCS] 3 times until February 23, before receiving an initial response. When you did reply, you indicated you were working on the request. You also asked if I wanted to “narrow down the search” so that you “might be able to provide a faster response.” I replied to that message — followed up more times to get a response. Finally you indicated again on March 28 that you were continuing to work on the request.

     

    It is unacceptable to learn now, 3.50 months after submitting the request and following up numerous times to get a reply, that the records I requested are “hard copy only” and must be copied or inspected in-person. Given all my previous experiences making requests to your office, I am concerned GCS may be intentionally delaying fulfillment of requests by allowing them to “sit” until staff has availability or feels like addressing. Under NC Public Records Law, GCS is required to “promptly” process all valid public records requests. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website.     I respectfully ask that legal staff take immediate action to resolve this issue and ensure that ALL public records requests are being fulfilled by GCS as required under NC Public Records Law.

    I’m not sure what you mean.

     

    If there are any records of “… out-of-county work travel and any consulting travel from January 01, 2018 through December 01, 2020 for former Guilford County Schools employees Sharon Contreras and Tony Watlington.” … then this happened during the course of their employment, and I would imagine these are still public records you are legally required to maintain and provide, regardless of whether someone is currently employed or not. Please correct me if I am mistaken.

     

    I do not have any other clarification to provide, and I do not wish to further narrow this request. If there is a particular reason it cannot be fulfilled as written, please specify where the reason for its denial is justified under NC Public Records Law.

    Unfortunately, I cannot email you directly through your records portal to try to follow up … since you do not have the portal set up in that way. I find it unreasonable that I should have to communicate with you in such a cumbersome manner, just to try and get a response. This is an unnecessary / extra barrier to access public information, as I have already provided all of the required details to your organization via my records request submission through the portal on 01/11/23. I would expect to have received some response confirming receipt of the request, and providing an indication of the timeline for completion of the request.

     

    I want to express my concern regarding the management of this request, as I worry that GCS is not processing public records requests in compliance with the Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html.
    I would highly recommend that Guilford County Schools revisit their current public records request fulfillment process to ensure you’re in compliance with the Law, and that you fulfill requests in a timely manner.

    I also want to note that I haven’t had much luck using your request portal, or contacting your various records officers / email addresses about requests over the past few months.

     

    It is not possible for me to send you a follow up email directly through your records portal … since you do not have the portal set up that way. Additionally — for months, the messages I’ve sent to Jose’s justfoia address above regarding various requests, continue to bounce back to me with a notice that says they’ve been “blocked” by [email protected] . ** See screenshot attached.

     

    This tells me that my email address ([email protected]) has been “blocked” as spam, or for some other reason by GCS, and isn’t being accepted.

     

    Please correct that designation so that this doesn’t continue to happen in the future. I am a real person making a valid public records request under the NC Public Records Law, and I expect for my email address to be accepted and responded to in a timely manner.
